Q:  How do the CC&Rs work?

A:  Each and every person who purchased a home in this community signed a contract stating that they received a copy of the CC&R’s, Bylaws, Rules, Architectural Guidelines and Articles of Incorporation - and that they agreed to follow them. This was one of the the many, many papers you signed at your home closing. Every homeowner and resident (including renters) is required, by law, to follow them (until such a time that they are legally amended or if a higher authority, such as the City or State, passes a law which supersedes them.)


Q:  If I have a question, complaint, or believe that I received a violation letter that should have been sent to my neighbor, who do I talk to? Can I ask a Board Member?

A:  Contact the property management company. They are the ones who do the inspections and send out the letters. Their phone number and email address are both on the Contact Us page, and their contact info is also on the letter you received. They are the only ones who can help you. Please do not contact Board Members directly, they will only ask you to contact the management company.


Q:  I am a new resident, and have not received any information on how to pay my monthly assessments. Is there something I should do?

A:  Yes! If you have not received a coupon book yet, that may mean that your title company has not sent information to our Property Management company. You can still begin paying your monthly assessments by contacting Equinox One and telling them your situation. They will explain how you can begin paying so you don’t get behind.


Q:  Violations - Who is responsible for policing the association and identifying all the violations?

A:  Our property management company, Equinox One, assigns a Property Manager who is responsible for many things, including identifying CC&R violations. Additionally, any member can report a violation to the Property Manager. The Property Manager will seek to verify the violation, and if it is verified, will issue a notice of violation. They cannot, however, disclose to you whether or not your neighbor received a letter of violation. That is a privacy issue.


Q:  Do I need permission to repaint my house?

A:  That depends. If you are going to use the exact paint colors and paint schemes that were used by the builder, then no, you do not need “permission”, but the Architectural Chairman should be notified of the pending work, and when you plan to begin the work.

If you are going to change the colors, in any way, or if you are going to change the paint scheme, i.e. paint pop outs, change door color, or trim, basically anything different than the way your house was originally painted, you must get approval via the Architectural Request Form. You can find that form on the documents page.

The best thing to do is to fill out and submit the forms no matter what.


Q:  My neighbor’s dog is barking constantly and bothering us. What can I do about it?

A:  There are three approaches to resolving this problem. The first is to approach your neighbor in a friendly manner and ask if they are aware of the problem, and ask them to correct it. The second is through through the City of Chandler Police Department, and the third is through the property management company.

Chandler City Ordinances prohibit barking dogs. You should report the violator to the Chandler Police Department non-emergency number, 782-4130, to include the address of the owner and a description of the complaint, i.e. how long and how often the dog is, or has been barking. We recommend that you sign the complaint, otherwise it will just be a warning and no further action will be taken. Chandler has a good record of enforcement of this type violation and may be your best bet for stopping the irritant.

Barking dogs are a nuisance and a violation of Section 5, Paragraph 5.18 of the CC&Rs. Upon receipt of a complaint, Equinox One Property Management will issue a violation notice asking the homeowner to take corrective action. On receipt of a second violation complaint, the property management company may assess a fine for non-compliance.


Q:  There are stray cats around the neighborhood, how do we get rid of them?

A:  There are volunteers in Ray Manor who have trapped cats, got them spayed or neutered, then attempted to adopt them out whenever possible. If the cat is feral and cannot be adopted, the law says it MUST be re-released into the neighborhood where it was found. 


Note: If you feed a cat it will keep coming back, and will be considered to be yours. No feeding of stray or feral cats is permitted on Ray Manor community property. If you own a cat, it should not roam free, especially at night, or it could end up trapped, sterilized and adopted out.

Q:  My neighbor constantly over waters the block wall between us and it is disintegrating at the bottom. If it falls, am I responsible for half the repair cost?

A:  No.  Section 5, paragraph 5.20 (b) of the CC&Rs clearly states that if a party wall (the wall between two residences) is damaged due to omission, or negligence of the neighbor, his family, or guests, that neighbor is solely responsible for the repairs costs. It would be best to notify your neighbor because they may be unaware. It would also be a good idea to notify the property management company, so it is on record.

Q:  Did the board decide not to allow parking on the streets?

A:  The Board DID NOT MAKE THIS DECISION, it has been in the CC&R’s since they were written by the original builder. Residents should not park on the street for any extended period of time, this includes overnight parking. If more than 5 cars are registered to people living in your home, please notify the management company.

Q:  When do people begin putting up lights for the December holidays. and when should they be taken down? Also, are there any restrictions or guidelines for decorating?

A:  People generally begin decorating their homes in mid to late November. Decorations should be removed no later than the second weekend of January. As long as decorations are not offensive or considered a nuisance to your neighbors (ie: too bright, attracting too much traffic) you can pretty much decorate as you wish. The neater the appearance of your decorations, and the more cohesive the overall design is, the more they will be appreciated by others.


Q:  If I have a question or comment, can I just go to a board member's house to get answers?

A:  Board members, although they may be happy to help, should NOT be contacted at their homes.

Q:  Do board members get compensated for their time?


A:  No compensation of any kind is ever given to board members. They donate their time freely.
